New Delhi: Harvard University has advised international students and scholars to carefully review their travel plans and consider returning to the United States before September 15, ahead of proposed changes to US visa rules for F-1 and J-1 visa holders.
The upcoming changes from the US Department of Homeland Security (DHS) could alter how long international students are allowed to remain in the country. The new system is expected to replace the existing “duration of status” arrangement with a fixed period of authorised stay for many students and exchange visitors.
Under the proposed rules, students entering the US could receive an “Admit Until Date” on their Form I-94. This would specify the period for which they are permitted to remain in the country, rather than allowing them to stay based primarily on their continued compliance with their academic programme and immigration requirements.
Harvard has warned students that the timing of international travel could become particularly important. Those who are already in the US and maintaining valid immigration status when the new rules take effect may fall under transition provisions. However, students who leave the country and attempt to return on or after September 15 could potentially face the new admission framework.
The changes could have implications for students who need additional time to complete their programmes. They may have to apply through a formal extension process instead of relying on the existing duration-of-status system. Other areas, including programme changes, university transfers and grace periods, could also be affected.
The issue is especially significant for Indian students, who make up a large proportion of the international student population in the US. Students planning to travel to India or another country around the September 15 deadline have been advised to check their visa documents, Form I-20 or DS-2019 and I-94 records before making travel arrangements.
Harvard has also encouraged students to consult their university’s international office before travelling. Those planning to apply for or extend OPT or STEM OPT may need to pay particular attention to the proposed requirements.
The proposed policy is facing legal challenges from higher education and labour organisations. However, until there is a court ruling or a change in government policy, students are being encouraged to follow official announcements closely.
For international students, the key message is clear: travel around the September 15 deadline could have immigration consequences, so checking individual circumstances and seeking guidance before leaving the US may be crucial.
